Sweep Rules

SWPMSystem, LLC ("SWPMSystem"), individually and/or through its licensed Partners (each, a "Sponsor"), provides an online platform that offers Participants the opportunity to engage in entertaining gameplay experiences. Additionally, to promote the platform, we and/or our Partners may give away sweepstakes entries referred to as SweepCoins as detailed below (the "Sweepstakes"). These SweepCoins can be used to play sweepstakes games for a chance to win additional SweepCoins and to accumulate eligible SweepCoins that can be redeemed for prizes with real-world value, subject to the terms of these rules (the "Sweeps Rules").

NO PURCHASE OR PAYMENT IS NECESSARY TO OBTAIN SWEEPCOINS OR TO WIN OR CLAIM PRIZES. AN ENTRY OBTAINED AS A FREE BONUS IN CONNECTION WITH A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE YOUR CHANCES OF WINNING OVER AN ENTRY OBTAINED WITHOUT ANY PURCHASE OR PAYMENT. BY ENTERING, YOU AGREE TO THESE SWEEPS RULES, WHICH ARE A CONTRACT. PLEASE READ THE SWEEPS RULES CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

RECEIVING SWEEPCOINS DOES NOT MEAN THAT YOU HAVE WON ANYTHING OF VALUE. SEE ADDITIONAL RULES BELOW ABOUT GAMEPLAY REQUIREMENTS AND TERMS AND PROVISIONS RELATING TO REDEMPTION OF SWEEPCOINS. THESE SWEEPS RULES CONTAIN AN ARBITRATION AGREEMENT, WHICH REQUIRES, TO THE EXTENT PERMITTED BY LAW, THAT ALL DISPUTES BE RESOLVED BY BINDING ARBITRATION, AND SWPMSYSTEM AND PARTICIPANTS AGREE TO ONLY PURSUE CLAIMS AGAINST SPONSOR AND ITS AFFILIATES AND/OR SEEK RELIEF IN ITS OR THEIR INDIVIDUAL CAPACITY. SWPMSYSTEM AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A className ACTION FORMAT, OR AS A PLAINTIFF OR className MEMBER IN ANY className OR REPRESENTATIVE ACTION OR PROCEEDING.

These Rules must be read in conjunction with the Website's Terms and Conditions, Privacy Policy, Responsible Gameplay Policy, and any other pertinent documents relating to your use of the Website (the "Documentation"). Any terms defined within the Documentation and not explicitly defined in the Sweeps Rules shall have the meaning provided in the Documentation. 1. General.

   1. The Sweepstakes shall be governed by these Sweeps Rules. By entering, all Participants agree to be fully and unconditionally bound by these Sweeps Rules and the decisions of the Sponsor(s), whose decisions shall be final and binding in all respects.
   2. The Sweepstakes is subject to applicable federal, state, and local laws, and any other applicable law, rules, or regulations. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
   3. Winning and receiving a Prize is contingent upon fulfilling all requirements set forth in these Sweeps Rules.
   4. The Sweepstakes is open only to Eligible Participants. ANY PARTICIPATION IN A PROMOTION BY A PERSON WHO IS NOT AN ELIGIBLE PARTICIPANT IS VOID, INCLUDING IN JURISDICTIONS WHERE PARTICIPATION IS PROHIBITED BY LAW.
   5. The Sweepstakes are offered on the Website concurrently with our Gold Coin Games. Each sweepstakes runs from the January 1 to December 31 each year (the "Sweepstakes Period"); provided that SWPMSystem reserves the right to: (i) cancel any Sweepstakes Period and/or any Sweepstakes offered during such period pursuant to these Sweeps Rules and our Terms and/or (ii) discontinue its offering of any Sweepstakes following the conclusion of any Sweepstakes Period, as determined in SWPMSystem's sole discretion. SWPMSystem's servers are the official time-keeping device for any Sweepstakes offered on the Website.

2. Social Network Disclaimer.

   You agree and acknowledge, as a condition of participating in the Sweepstakes, that Meta Platforms, Inc., X Corp., Apple Inc., Google LLC, or Amazon.com, Inc. and their owners, directors, officers, employees, contractors, agents, representatives, parents, subsidiaries, attorneys, insurers, and associated corporations and entities (individually and collectively referred to herein as the "Social Networking Sites" or "SNS") do not sponsor, endorse, or administer, nor are they in any way associated with, the Sweepstakes. As a condition of participating in the Sweepstakes, you further acknowledge and agree that you shall release the SNS from any and all liability arising out of or relating to your participation in the sweepstakes, or your acceptance, use, or misuse of a Prize. All questions regarding the Sweepstakes must be directed to a Sponsor, not SNS.

3. Eligibility.

   1. The sweepstakes is open only to Participants in the Permitted Territories with a valid, active Account who are at least eighteen (18) years old or the age of majority in the jurisdiction in which the Participant is located.
   2. Participation is void in the states of Connecticut, Hawaii, Idaho, Louisiana, Maryland, Michigan, Mississippi, Nevada, New York, Washington, and West Virginia, as well as any outlying U.S. territories or possessions, and any jurisdiction outside of the United States.
   3. Owners, officers, directors, members, managers, employees, representatives, and agents of any Sponsor and each of its respective parent companies, affiliates, subsidiaries, franchisees, partners, fulfillment agencies, and any other companies associated with the design or execution of the sweepstakes, including, any prize provider, (individually and collectively referred to herein as the "Sponsor Affiliates"), as well as each of their Immediate Family Members, as defined below, and Household Members, as defined below, are not eligible to participate in or win the Sweepstakes. "Immediate Family Members" shall mean spouse, parents, stepparents, legal guardians, children, stepchildren, siblings or stepsiblings and each of their spouses regardless of where they reside. "Household Members" shall mean those people who share the same residence at least three (3) months a year. Former Sponsor Affiliates cannot participate until three (3) years from their final date of their affiliation with the relevant Sponsor.

4. Entering the Sweepstakes.

   1. NO PURCHASE OR PAYMENT OF ANY KIND IS REQUIRED TO ENTER UNDER ANY METHOD OF ENTRY OR TO WIN OR CLAIM PRIZES. AN ENTRY OBTAINED AS A FREE BONUS IN CONNECTION WITH A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE YOUR CHANCES OF WINNING OVER AN ENTRY OBTAINED WITHOUT ANY PURCAHSE OR PAYMENT.
   2. To participate in the Sweepstakes, Participants must have an active Account. If you do not have an Account, you may create one at no cost on our Website: www.liveplaycasino.com.
   3. The Service offers two modes of gameplay: (1) Gold Coin Games, in which only Gold Coins may be used for gameplay and (2) SweepCoin Games, in which only "Sweep Coins" may be used for gameplay. Participants are able to select which mode of gameplay they would like to participate in on the Website.
   4. When Participants play SweepCoin Games, they will play Games using SweepCoins for the chance to win additional SweepCoins, which may be redeemed for Prizes. SweepCoins may be obtained as described below. NO PURCAHSE OR PAYMENT OF ANY KIND IS NECESSARY TO OBTAIN SWEEPCOINS. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.
   5. SWEEPCOINS CAN NEVER BE PURCHASED. Eligible Participants who access the Service may obtain SweepCoins for free in any of the following ways:
   1. As a free bonus when purchasing certain Gold Coin packages. Gold Coins are not eligible for Prize redemption. The number of bonus SweepCoins a user will receive with a Gold Coin purchase will be clearly displayed on the purchase screen. GOLD COINS CAN NEVER BE REDEEMED FOR PRIZES.
   2. As a daily login bonus.
   3. As an occasional mystery bonus at login.
   4. As an Account creation bonus.
   5. As a bonus for linking your Facebook account to your Account.
   6. As a reward for verifying your phone number.
   7. By inviting others through a custom, persona link. We reserve the right to limit the number of invitations that a User may extend in any twenty-four (24) hour period.
   8. ALTERNATE METHOD OF ENTRY. You may receive three (3) SweepCoins for free by sending by mail a request ("Mail-In Request") on a post card or piece of blank paper (which must be 3" x 5" and unfolded) containing the following statement, handwritten in blue or black ink: "I am requesting free SweepCoins (SC, FICO or FC) to participate in the Promotion. By submitting this request, I hereby declare that I have read, understood, and agree to be bound by your Terms and Conditions and Rules.” Mail-in requests must include the following:
   1. On the front of the envelope: the return mailing address associated with Your Account along with the words "SweepCoins"
   2. On one side of the piece of paper:
   • Your Full name as displayed on the User's government-issued identification;
   • The email address registered to the Account;
   • The return address registered to the Account; and
   • The user ID registered to the Account.
   3. Requests must be handwritten and may not be made by any electronic method, such as an autopen. If we, in our sole discretion, determine that a request is not handwritten, the request will be deemed void.
   4. Handwriting must be legible. Illegible requests will be deemed void.
   5. The request must be mailed from the same state or province as the mailing address registered to your Account.
   6. The envelope must be addressed to Sweepium LTD, 1950 W Corporate Way #68481 Anaheim, CA 922801.
   7. Requests are limited to one per envelope.
   8. There is no limit to the number of requests that can be made, but each request must be limited to one per envelope.
   9. Users may be required to complete certain verification and "know-your-customer" ("KYC") processes to be eligible to claim free SweepCoins.
   10. In the event of a dispute regarding the identity of the Participant who has submitted a Mail-In Request, or whether a Mail-In Request satisfies the requirements set out above, that cannot be resolved to SWPMSystem's satisfaction, the relevant Mail-In Request will be deemed invalid.
   11.  Neither SWPMSystem nor any Sponsor is responsible for lost, late, incomplete, invalid, illegible, or misdirected Mail-In Requests or SweepCoin allocations. FOR THE AVOIDANCE OF DOUBT, COMBINED REQUESTS SENT VIA PACKAGE OR PARCEL DO NOT MEET THE REQUIREMENTS SET OUT ABOVE AND WILL BE DEEMED INVALID.
   12.  SWPMSystem reserves the right to add other methods or alter the above methods of obtaining SweepCoins from time to time. SWPMSystem will allow for a grace period for those Mail-In Requests already in the mail but not received by SWPMSystem before any update to these Sweeps Rules. All dates will be cross-referenced to the initial date written on the Mail-In Request and the postage date. If it is determined that the Participant has tampered with the initial date written on the Mail-In Request or with the postage date, the Request Card will be deemed invalid. Any Mail-In Request received after the grace period expires will be reviewed in accordance with the updated Sweeps Rules.
   13. Your SweepCoin balance will be displayed in your SweepCoin Wallet on the Website.
   14. You will be able to see Your total, unplayed, and redeemable SweepCoin balance by clicking the SweepCoin Wallet while on the Website. Only SweepCoins earned while playing SweepCoin Games may be redeemed for Prizes.
   15. Use of any automated or other system(s) to participate in SweepCoin Games, to acquire SweepCoins, or win prizes is prohibited and will result in disqualification from playing games on SWPMSystem. To opt-out of SweepCoin Games, a Participant need only play Gold Coin Games and not play SweepCoin Games.
   16. SweepCoins may be forfeited if a Participant's Account is deactivated for any reason at SWPMSystem's sole discretion, or for any other reason, also at SWPMSystem's sole discretion.
   17.     Participants and/or potential winners may be required to provide proof of identification and eligibility as required by Sponsor. If it is discovered or suspected that a Participant has registered or attempted to register for the Sweepstakes using multiple identities, all of that Participant's entries will be declared null and void and any prize such Participant might have been entitled to win will not be awarded to and may be revoked from such Participant. Any form of entry other than those described herein is void. Using an automated system to participate in the Sweepstakes or attempting to subvert the Sweepstakes entry process is also prohibited and may result in disqualification. Sponsor is not responsible for incorrect or inaccurate transcription of entry information, computer, online or human error, technical malfunctions, any omission, interruption, defect, or any other error, including, without limitation, lost, late, incomplete, invalid, illegible or misdirected entries, all of which may constitute grounds for disqualification in Sponsor's sole and absolute discretion. If a problem occurs in the entry process, the entrant is solely responsible for verifying that the entry process has been validly completed. Sponsor shall have no obligation to advise an entrant of an incomplete entry. All entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Entrant is responsible for all online charges incurred with any Internet service provider and/or wireless carrier.
   6. In the event of a dispute as to the ownership of Sweep Coins, only the authorized account holder of the email address registered to the Account will be deemed to be the Participant. The "authorized account holder" is the person assigned the email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
   7. SWPMSystem's decisions as to the administration and operation of the Sweepstakes are final and binding.

5. Winning Prizes

   1. To participate in the Sweepstakes and win Prizes, Participants must have an active Account. Accounts may be created at no cost at our website: https://www.liveplaycasino.com.
   2. SweepCoins used in SweepsCoin Games will be withdrawn from the Participant's unplayed SweepCoin balance. SweepCoins must be played a minimum of one (1) time to be eligible for redemption ("Playthrough Requirement"). We may, at our sole discretion, modify this Playthrough Requirement.
   3. All SweepCoins won while playing a SweepCoin Game will be added to the Participant's redeemable SweepCoin balance.
   4. In the event that a Participant uses SweepCoins in a SweepCoin Game but their unplayed SweepCoin balance is insufficient to cover the minimum amount required for play, the additional SweepCoins needed to reach the minimum will be withdrawn from the Participant's redeemable SweepCoins balance and those SweepCoins will be deemed unplayed and may not be returned to the Participant's redeemable SweepCoins balance. In the event that there is a technical issue with a spin, the spin will be voided and all SweepCoins played in that spin will be returned to the player in their unplayed SweepCoins balance.
   5. Every one (1) SweepCoin won through participation in the Sweepstakes can be redeemed at a Prize value of 1 USD. SWEEPCOINS HAVE NO REAL MONETARY VALUE UNTIL A REDEMPTION REQUEST HAS BEEN APPROVED AND PROCESSED. APPROVAL OF REDEMPTION REQUESTS IS AT THE SOLE DISCRETION OF SWPMSYSTEM.
   6. We reserve the right to impose Playthrough Requirements on any SweepCoins provided by us to Participants, including but not limited to, SweepCoins provided in the following circumstances:
   1. As a bonus for creating an Account;
   2. As A reward for connecting a Facebook account to an Account;
   3. A daily bonus;
   4. A phone number verification bonus;
   5. Referring new users;
   6. Marketing or promotional purposes;
   7. For any or no reason; or
   8. The Alternative Method of Entry;
   7. Users may not claim or receive any SweepCoins or Prizes for which a Participant is ineligible. We reserve the right to retrospectively void any SweepCoins or Prizes for any or no reason.
   8. Before any Prizes are processed, we will review a Participant's play for any irregular playing patterns. In our sole discretion, we reserve the right to determine which activities constitute "irregular play" from time to time and to withhold any withdrawals where irregular play has occurred to meet Playthrough Requirements.
   9. In the event we believe a Participant has abused or has attempted to abuse SweepCoins, we may, at our sole discretion, deny, withhold, or withdraw from you any SweepCoins, or rescind any policy either temporarily or permanently, or terminate your access to our Website and/or terminate your Account. In such circumstances, we shall be under no obligation to refund you any SweepCoins or purchases made via your Account.
   10. At any point, a Participant may decide to forfeit all or a portion of their SweepCoins. Forfeiture of SweepCoins may result in the loss of any remaining SweepCoins and any Prize(s). Forfeitures are non-reversible, and no exceptions will be made.
   11. All decisions we make regarding the administration and operation of the Promotions, Games, and winnings are final and binding.
   12. Unless otherwise required by us, any SweepCoins collected by a Participant must be played once for those SweepCoins to become eligible for redemption for real Prizes. In our sole discretion, we may require that any SweepCoins be subject to a Playthrough Requirement before becoming eligible for redemption towards real Prizes.
   13. The odds of winning each SweepCoin Game can be found within the rules, pay table, or win table associated with such SweepCoin Game. The odds are the same regardless of whether the SweepCoins used were obtained through the Alternative Method of Entry, as a free bonus with the purchase of Gold Coins, or any other promotional method.
   14. We reserve the right to right to modify, alter, or change the rules, regulations, and prize amounts of any SweepCoin Game at any time in our sole discretion. Participants can view the actual and any amended details by clicking the pay table button in each game. It is the sole responsibility of the Participant to check the Prize win rate each time before they participate.
   15. In the event that we modify Promotion, a User's continued participation in the Promotion constitutes acceptance of the modified terms.

6. Prizes

   1. A Participant may only obtain a Prize by redeeming redeemable SweepCoins obtained while playing SweepCoin Games.
   2. To be eligible to receive a Prize:
   1. The Participant must be an Eligible Participant in accordance with these Sweeps Rules and the Terms; and
   2. The Participant's details must match those of the Participant's Account.

7. Publicity

   Except where prohibited or restricted by law, a Participant's acceptance of a Prize constitutes the Participant's agreement and consent for Sponsor and any of its designees to use and/or publish their full name, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by the Participant regarding the Sweepstakes or Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval.

8. General Conditions

   1. Neither SWPMSystem nor any other Sponsor is responsible for programming, coding, or other web production errors and SWPMSystem and Sponsor(s) may rescind, cancel or revoke the Sweepstakes based on any such error without liability at its sole and absolute discretion. Sponsor also reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond SWPMSystem or Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by SWPMSystem or Sponsor, at its sole and absolute discretion.
   2. SWPMSystem and Sponsor(s) also reserve the right, at their sole and absolute discretion, to disqualify any individual they find to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Sweeps Rules or any other promotion or in an unsportsmanlike or disruptive manner.
   3. ANY ATTEMPT BY YOU OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SWPMSYSTEM AND SPONSOR(S) RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
   4. Participants agree to be bound by the Sweeps Rules and decisions of SWPMSystem, Sponsor(s), and/or a Sponsor's representatives, which are final and binding in all respects. Submitted entry materials become the sole property of SWPMSystem and/or Sponsor(s), and will not be acknowledged or returned. The failure of Sponsor to comply with any provision of these Sweeps Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism (or threat thereof), act of public enemies, actions of governmental authorities outside of the control of SWPMSystem and/or Sponsor(s) or other force majeure event will not be considered a breach of these Sweeps Rules.
   5.   The invalidity or unenforceability of any provision of these Sweeps Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Sweeps Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. SWPMSystem and/or a Sponsor's failure to enforce any term of these Sweeps Rules will not constitute a waiver of that provision. You agree to waive any rights to claim ambiguity of these Sweeps Rules or any Sweepstakes materials. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.
   6. We reserve the right to update, modify, or otherwise amend these Sweeps Rules, and such changes shall go into effect as of the "Last Updated" date provided above. Your continued participation in the Service shall constitute your acceptance of all changes to these Sweeps Rules. If you do not agree to any changes set forth in these Rules, you should not continue participating in any Sweepstakes or otherwise access the Website. When the Sweeps Rules have been updated, you will be notified the next time You log into your Account. Continued participation in the Sweepstakes after modification of these Rules means that You accept the modified Sweeps Rules.
   7. Nothing in these Rules shall create or confer any rights or other benefits in favor of any third party except as expressly provided herein.

9. Limitations on Liability

   1. SWPMSystem, any and all Sponsor(s), and any and all Internet server(s) and internet and cellular telephone and mobile data access provider(s), and each of its respective companies, affiliates, subsidiaries, franchisees, partners, and all of their owners, officers, directors, members, managers, employees, representatives, and agents (collectively, "the Released Parties") are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers or software, including without limitation, any injury or damage to Participant's or any other person's computer or mobile device relating to or resulting from participation in the Sweepstakes; inability to access the Service, Website, or any pages thereof; theft, tampering, destruction or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer, mobile telephone or electronic malfunction or traffic congestion on telephone lines, mobile telephone networks, or the Internet or any website or for any other reason whatsoever; typographical, printing or other errors; late, lost, stolen, mutilated, misdirected or postage-due mail, or any combination thereof. Any and all entry materials will become the property of SWPMSystem or the applicable Sponsor and will not be acknowledged or returned. False, fraudulent or deceptive entries or acts shall render entrants ineligible. By entering the Sweepstakes, entrants affirm that they have read and accepted these Sweeps Rules.
   2. Released Parties shall not be liable to Participants or any other person for failure to supply the Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Released Parties' sole control.
   3. By entering this Sweepstakes, You agree that Released Parties shall not be liable for personal injuries, death, dismemberment, damages, expenses or costs or losses of any kind resulting from participation in this Sweepstakes, or from acceptance of or use or inability to use a prize or parts thereof, including without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, dismemberment, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Each Participant who receives a Prize releases the Released Parties from any and all liability and responsibility with respect to the Prize (including any property loss, damage, personal injury or death). Each Participant who receives a Prize acknowledges the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prize.

10. Controlling Law and Jurisdiction

    1. Except as otherwise provided in the Terms and Conditions, all matters concerning the construction, validity, interpretation, and enforcement of these Terms and Conditions are governed in accordance with the law of the State of Delaware, without consideration of the choice of law or conflict rules. Except as provided in the "Dispute Resolution and Arbitration" Provision (above), the exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms will be the state and federal courts located in the State of Delaware and each of the parties hereto waives any objection to jurisdiction and venue in such courts.
    2. DISPUTE RESOLUTION AND ARBITRATION AGREEMENT. YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO USE OF THE APPS OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE (AND RECOVERY SHALL BE LIMITED TO THAT ONE-YEAR PERIOD) OR BE FOREVER BARRED.
